Who we are
DivisionNine (“Division 9”, “D9”). Contact: division9agency@gmail.com.
Responsibility for ad content
Copy, claims, prices, offers, discounts, reviews, ratings, logos and comparisons in ads made with D9’s systems are supplied or approved by the client. The client is fully responsible for their accuracy and for complying with all laws and advertising rules that apply to them. D9 is not liable for the content of these ads.
Prices, discounts and promotions
The client is responsible for the accuracy of prices, reference (“was”) prices, discounts, promotion periods and available stock in its ads.
Third-party reviews, ratings and logos
If the client uses reviews, scores or logos from other parties, such as Trustpilot or Klarna, the client makes sure it is entitled to do so and that it meets those parties’ terms.
Comparisons
The client is responsible for comparisons with other products or categories in its ads.
Images and brand assets
The client warrants that it has the right to use all photos, logos, fonts and other material it supplies, including material from its suppliers. The client indemnifies D9 against third-party claims relating to this material.
Publishing on ad platforms
D9 supplies creatives. The client publishes and manages its own ads, for example in Meta, and decides what goes live. If D9 withdraws a creative, the client switches off the related ad itself. D9 is not responsible for ads that keep running.
Ownership
Once paid for, the client receives a full right to use the delivered creatives. The systems, code and templates used to make them remain the property of D9.
Liability
To the extent permitted by law, D9’s liability is limited to the amount the client paid D9 in the three months before the damage occurred. D9 is not liable for indirect or consequential damage.
Privacy
Our Privacy Policy explains how we handle personal data: who processes it for us, how long we keep it and what your rights are.
